3 Things to Know about Senior Living Regulations and Laws
A variety of laws and regulations are set forth by each state in the US which are there to protect residents of senior living communities. Whether it is a nursing facility, assisted living, or independent living senior community; it should abide by all of the required regulations and laws including quality standards, certifications, licensing and other types of regulations. These laws and requirements will vary by state, so it is important to be kept up-to-date on the current regulations for your state before residing in any senior living community.
Every state has specific requirements for certification of the senior living community as well as employees of the community such as the nursing staff, office and administrative professionals, housekeeping and dietary services staff. This may include a number of years of related work experience, education from an accredited college or university, having no criminal record, passing a drug screening, and other details. The state might also require nursing and medical staff to pass a written or oral exam as required by the certification board for that staff as well as on-site training for certification.
Aside from certification, licensing may also be required of the medical facilities, nurses, caretakers and other medical professionals employed by the senior living community. The education and training requirements for licensing will also vary by the state. For instance, in California, the nursing staff is required to have a minimum of 10 hours of on-site training within the first month of employment as well as four hours of training a year following that first month. Other states have similar requirements for obtaining and maintaining their license.
In order to administer medications to residents of the senior living community, there may be regulations regarding special licensing for the medical staff. Some states require only licensed physicians or registered nurses to administer medications, while others give permission to un-licensed staff or residents for assisting with medications, but under proper supervision.
There are also laws and regulations in regards to the senior living community maintaining proper security measures such as having a fire safety clearance from the local fire department, having an emergency disaster plan, resident evacuation plan, and proper disaster emergency supplies and first aid kits on-site.
According to the state in question, the senior living community may be required to offer certain services that are considered mandatory such as prepared meals, personal care services, housekeeping, medical services, activities, or certain amenities and accommodations.
